Introduction

The Seller operates an e-commerce business and provides online product sales via the website laguiole-official.com. These Terms and Conditions of Sale (hereafter referred to as “Terms”) apply exclusively to consumer Buyers. These Terms may be subject to modification, with the applicable version being those in effect at the time the Order is placed.

Article 1 – Definitions

For the purposes of these Terms, the following definitions apply:

  • Buyer: An individual who is at least 18 years old with legal capacity to contract, purchasing products through the website.
  • Order: A purchase request made by the Buyer for one or more products, accepted by the Seller according to these Terms.
  • Email or Electronic Mail: A document sent or accessed through a network, often containing text and possibly attachments such as images or sounds.
  • Internet: The global network used for exchanging messages, multimedia, and files, operating via a shared protocol.
  • Party(ies): Refers to the Buyer and/or Seller.
  • Product: Goods offered for sale on the website by the Seller.
  • Website: The website located at laguiole-official.com where the Seller sells Products.

Article 2 – Purpose and Scope

These Terms outline the rights and obligations of both the Seller and the Buyer regarding product sales made via the website. The Terms apply to any product sales conducted through the website by the Seller.

Article 3 – Ordering

The Buyer confirms they have read and accepted these Terms prior to placing their Order. The Buyer acknowledges that by confirming their Order, they accept these Terms. The Buyer also agrees that the Terms are provided in a format that allows storage and reproduction as per article 1369-4 of the French Civil Code, and that they are responsible for such storage. All contractual information is in French and will be confirmed no later than delivery. To place an Order, the Buyer must select products and quantities on the website and add them to their cart. To complete the Order, the Buyer must provide delivery, billing, and payment information. The sales contract is finalized when the Buyer clicks “Confirm Order” during the verification process. Before this step, the Buyer may modify their Order and details. A confirmation email will be sent to the Buyer upon receipt of the Order.

If a Product is unavailable, the Seller will notify the Buyer by email and cancel the Order, fully or partially, at the Buyer’s choice. Refunds will be processed within 30 days if payment has already been made. The Seller reserves the right to reject an Order from a Buyer with an ongoing payment dispute.

Article 4 – Payment

Product prices shown on the website exclude shipping costs, which are detailed before Order confirmation. The Seller may update prices at any time, but Products are billed based on prices valid at the time of Order confirmation. Payment is required upon confirmation via credit card or bank transfer (fees apply to the Buyer). Payments by credit card are irrevocable, and the transfer of ownership of the Product only occurs once the Seller has received full payment.

Article 5 – Delivery

Products are shipped to the delivery address specified by the Buyer and can be sent worldwide, except to P.O. boxes. Orders within France are shipped via Colissimo, while international Orders use FedEx, with delivery requiring a signature. If a package arrives damaged or opened, the Buyer must check the contents and, if necessary, refuse the package and note this on the delivery slip. The Seller aims to deliver by the date confirmed at Order. Delays of more than seven days may result in the Buyer canceling the Order, with returns and refunds handled as outlined in Article 6.

Article 6 – Cancellation, Withdrawal, and Refunds

Upon receipt of the Products, the Buyer has a seven-day withdrawal period to return the items without providing a reason. The Seller will refund the Buyer within 30 days, provided the Products are returned in perfect condition for resale. Personalized or limited-edition items cannot be canceled or returned. To initiate a return, the Buyer must first obtain a return number by emailing contact@laguiole-official.com with their Order number. The return number must be included with the returned items, and shipping costs are the Buyer’s responsibility. It is recommended to return items via tracked or registered delivery with insured value.

Article 7 – Warranty

The Buyer benefits from legal protection against hidden defects as per Article 1641 of the French Civil Code, valid for up to two years from discovery. The Buyer also has a two-year legal guarantee of product conformity, starting from the delivery date. Complaints should be emailed to contact@laguiole-official.com with details of the Order and the issue. The Seller must agree to any product returns.

Article 8 – Liability

The Seller’s liability is limited to direct, foreseeable damages related to the Buyer’s use of the site and Products, excluding indirect damages. The Seller is not liable for failure to fulfill obligations due to the Buyer, third parties, or unforeseeable circumstances such as force majeure.

Article 9 – Intellectual Property

The website is protected by intellectual property laws. Any unauthorized reproduction, modification, or use of its content is prohibited and constitutes infringement.

Article 10 – Personal Data

Personal data collected during the Order process is processed by the Seller in compliance with the relevant data protection laws.

Article 11 – Evidence Agreement

Electronic records maintained by the Seller’s systems will serve as proof of communications, Orders, and payments between the Parties.

Article 12 – Partial Invalidity

If any provision of these Terms is deemed unlawful or void, it will not invalidate the other provisions, unless they are inseparable.

Article 13 – Governing Law and Jurisdiction

These Terms are governed by French law. In case of disputes, the Parties will first attempt an amicable resolution. If unsuccessful, the matter will be taken to the appropriate courts.
